Terms of Service
Welcome to AI English Coach (the "App" or the "Service"). The Service is operated by Zhang Tao, an individual developer based in China ("we", "us"). These Terms are an agreement between you and us about your use of the Service. By creating an account or using the Service, you confirm that you have read and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
- The App helps adults practise spoken English with AI. It offers daily missions (reading, comprehension, retelling, conversation and review), real-time voice conversation with an AI teacher, corrections, learning reports and a language profile.
- The AI teacher is not a human and not a licensed or certified instructor. Your "estimated level" is calculated automatically from your practice to plan lessons. It is not an official exam result or a CEFR certification.
- AI can be wrong. Explanations, corrections and generated reading material may be inaccurate or incomplete. Do not rely on them as medical, legal, financial, immigration or other professional advice.
- Voice practice needs a network connection and microphone permission. Without microphone access you can still use parts of the App, such as reading.
2. Eligibility
You must be at least 18 years old, have full legal capacity, and be allowed to use the Service under the laws where you live. Do not sign up if you are under 18. If we learn that a minor is using the App, we will disable and delete the account.
3. Your account
- You can sign in with Apple, with Google or with an email code, and link several of these methods to one account. Keep your device, email and Apple / Google accounts secure; you are responsible for activity under your account.
- Your account is for you alone. Do not lend, transfer or sell it. One account can run only one voice practice session at a time.
- Tell us immediately if you think someone else is using your account.
4. Acceptable use
When using the Service you must not:
- post, or make the AI generate, content that is unlawful, violent, hateful, harassing, sexually explicit or that infringes anyone's rights;
- try to extract, reveal or change the App's system instructions or prompts, or "jailbreak" the AI teacher out of its English-teacher role;
- use the App as a general-purpose chatbot, a proxy to AI models, or for anything other than learning;
- access the Service with scripts, bots or other automated means, or scrape its content;
- get around free allowances, subscription limits or other technical protections, or reverse engineer the App;
- enter other people's personal information during practice without their consent;
- interfere with the security or stability of the Service, its servers or networks.
The AI teacher keeps conversations on learning topics and may decline unrelated or inappropriate requests. If you break these rules we may warn you, limit features, or suspend or close your account.
5. Subscriptions and payment
- Free plan: a free daily voice practice allowance (currently 10 minutes), a simplified learning report, up to 3 review cards per lesson and a basic language profile. The allowance and features shown in the App apply, and we may change them.
- Paid subscriptions: monthly and yearly auto-renewing subscriptions unlock more daily practice time, full reports and the full language profile. What each plan includes and its price are shown on the purchase screen, in the currency of your App Store country or region.
- Payment: subscriptions are purchased through Apple In-App Purchase and charged to your Apple ID account when you confirm the purchase. We never receive your payment details.
- Auto-renewal: your subscription renews automatically at the current plan price, and Apple charges your account within 24 hours before the end of the current period, unless you turn off auto-renew at least 24 hours before the period ends.
- Free trials: if a plan includes a free trial, it converts to a paid subscription when the trial ends unless you cancel at least 24 hours before then. Any unused part of a free trial is forfeited when you buy a subscription.
- Manage or cancel: go to iPhone Settings › your name (Apple ID) › Subscriptions. Deleting the App or your account does not cancel your subscription. After you cancel, paid features stay available until the end of the period you paid for.
- Refunds are handled by Apple under its policies; request one through Apple's "Report a Problem" page. We cannot issue refunds directly. This does not affect your statutory consumer rights.
- Price changes: we will give notice of subscription price changes, and ask for your consent where required, under Apple's rules.
- Daily practice allowances reset at 4:00 a.m. your local time. To keep the Service stable, we may apply reasonable limits to unusually heavy use.
6. Intellectual property
- The App, including its software, interface, lessons, the AI teacher's voice and character, belongs to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, for your own learning.
- You keep your rights in what you say and type. You grant us the licence needed to process it to provide and protect the Service. We use it only as described in the Privacy Policy; saving recordings to improve the product requires your separate opt-in.
- We may use feedback and suggestions you send us, free of charge, to improve the Service.
7. AI-generated content
- The teacher's replies, explanations, corrections, reading material, voice and reports are generated by AI and labelled as such in the App. The teacher's voice is synthetic.
- AI-generated content may be inaccurate, incomplete or biased and is not reviewed by a person in real time. Use your own judgement; you are responsible for how you use it.
- If a reply looks wrong or inappropriate, long-press it to report it.
- AI-generated content is for your personal learning only.
8. Third-party services
The Service relies on Apple and on third-party AI providers (see section 4 of the Privacy Policy). We do not fully control their availability. If a provider fails, we may temporarily switch you to text mode or another fallback.
9. Disclaimers and limitation of liability
- The Service is provided "as is" and "as available". We work to keep it reliable and accurate, but we do not promise that it will be uninterrupted or error-free, or that you will reach any particular learning outcome or exam score.
- To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses (such as lost profits or data). Our total liability to you is limited to the amount you paid for the Service in the 12 months before the claim arose.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as for intent or gross negligence, or your statutory consumer rights.
10. Termination
- You can stop using the Service at any time and delete your account in Settings › Legal › Delete account. After deletion, your data is handled as described in the Privacy Policy.
- We may suspend or close your account if you seriously or repeatedly breach these Terms or the law, or to protect users and the Service. If we end a paid service for reasons that are not your fault, we will handle refunds as the law requires.
- We may change or remove features. If we shut down the whole Service, we will tell you in the App in advance.
11. Apple-specific terms
- These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its content.
- Your use of the App must also follow the Usage Rules in the App Store Terms of Service.
- We are responsible for maintenance and support of the App; Apple has no obligation to provide either.
- If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App under its rules. To the extent permitted by law, Apple has no other warranty obligation for the App.
- We, not Apple, handle any claims relating to the App, including product liability, failure to meet legal or regulatory requirements, consumer protection, privacy and intellectual property claims.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
12. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, excluding its conflict-of-laws rules. We will first try to resolve any dispute informally; if that fails, the competent people's court at our domicile will decide it. This does not take away protections you have under the mandatory consumer laws of the country where you live.
13. Changes to these Terms
We may update these Terms. The version and effective date are shown at the top. For material changes we will tell you in the App and ask for your agreement again before you continue.
14. General
If any part of these Terms is found invalid, the rest remains in effect. Not enforcing a right is not a waiver of it. These Terms exist in Chinese and English; if they conflict, the Chinese version prevails.
